Terms of Service

These Terms of Service (“Terms”) are an agreement between you and NIX Development LLC (“NIX,” “we,” “us”) governing your use of the NIX Scoreboard app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use NIX Scoreboard

You must be at least 13 years old to use the Service. By using it you represent that you are 13 or older and that the information you provide, including your birth year, is accurate. One account per person. You are responsible for keeping your credentials secure and for everything done under your account. Signing in keeps you signed in until you sign out, reset your password, or delete the account, so treat a shared phone accordingly.

2. What the Service does

NIX Scoreboard scores your own screen time in tokens (NX), lets you add friends and form groups, and ranks everyone with the lowest score first over a day, week, month, or longer, or over a one-time race with a fixed end. It can award badges, day wins, and streaks, and let competitors send each other one-tap emoji jabs. Focus mode lets you block the other apps on your phone for a set time to take tokens off your day. The Service is free. There is nothing to buy in it.

3. Screen-time numbers & fair play

Your numbers are produced on your own device by Apple's Screen Time framework and synced automatically. They are approximate, they cover the categories you set up, and time outside those categories is priced as an unclassified remainder. Categories lock while you are competing; support can open a short re-selection window on request. You agree not to tamper with the tracking, spoof the app, run modified builds, or otherwise manipulate a score. We may correct or remove scores, results, and badges that we reasonably believe were gained by manipulation, and we may act on the account (see Section 11).

4. Focus mode

Focus mode is a tool you choose to start. For the session length you pick, it blocks the other apps on your phone using Apple's Screen Time controls. Phone, Messages, FaceTime, Maps, and your phone's Always Allowed list stay open. Each full focused minute takes tokens off your day up to what is on the board, and finishing the session adds a bonus. Ending early keeps the minutes but forfeits the bonus. You are responsible for anything you miss while apps are blocked; do not rely on Focus mode in a situation where you need an app to be available, and do not use it to restrict someone else's phone.

Phones down is Focus for a group, with one shared end time. Anyone who ends early, or turns off Screen Time access during it, gets no tokens off from that session, except credit already settled at midnight, and the others are told who picked up. If everyone who was in at the start finishes, each finisher also gets a group bonus. Joining blocks your apps right away, before the start. Everyone in a Phones down, and anyone invited to it, sees your display name and photo, including people who are not your friends, so only join with people you are comfortable sharing them with.

5. Groups, competitions, and rewards

A group leader can name the group, set its competition period and scoring categories, set how many jabs a day members may send, write reward text, remove members, and disband the group. Group members can see each other's numbers, breakdowns, ranks, results, and status as described in the Privacy Policy. If a leader deletes their account, leadership passes to the longest-standing remaining member; if none remain, the group is disbanded. One-time races end on their end date and their results are frozen.

Any reward is arranged solely among group members. A leader may describe a reward in text, and members honor it themselves. NIX does not provide, fund, hold, or guarantee any reward, and reward text is not a promise by NIX. The Service is a game, not a sweepstakes, wagering, or gambling product, and you may not use it to run one. How day wins, streaks, badges, and period results are decided is set by us and may change; we may correct results we reasonably believe are wrong.

6. Jabs and conduct between players

Jabs are one-tap emoji reactions with no free text. Do not use them, or display names, group names, reward text, or photos, to harass, bully, threaten, or impersonate anyone. You can remove a friend or leave a group at any time, which ends jabs between you. We may restrict or remove content or accounts that violate this section.

7. Your content

You keep ownership of the content you submit: your display name, group names and reward text you write, and any profile photo. You grant NIX a worldwide, non-exclusive, royalty-free license to store, resize, and display that content within the Service to make its features work (for example, showing your name and photo on a group board), for as long as you keep it in the Service. You are responsible for your content and must have the right to share it. We may remove content that violates these Terms.

8. Acceptable use

You agree not to:

• Harass, threaten, bully, or impersonate other people.
• Upload unlawful, hateful, or sexually explicit content.
• Cheat, automate, scrape, reverse-engineer the anti-cheat, or otherwise interfere with the integrity of the boards or the Service.
• Attempt to access accounts or data that are not yours.
• Use the Service to monitor or control another person's device.
• Use the Service in violation of any applicable law.

9. Notifications and email

If you turn notifications on, the Service can push you when you pass someone or someone passes you, in the final hours of a close race, when you receive a jab, a friend request or an accepted request, when you are invited to a group (or, on an older version of the app, added to one), when you are invited to a Phones down or something happens in one you are in, to suggest putting your phone down when your social, games, or entertainment time reaches 30 or 60 minutes in a day, on your first full day, to remind you to finish setup, when a period closes, when support unlocks your categories, and if your tracking has stalled. We do not push between midnight and 6am in your time zone, except Phones down invites and updates about a Phones down you are in. You can turn notifications off at any time in iOS Settings. We send email only for your account, such as a password reset link.

10. Support and adjustments

If a score looks wrong, contact support. We may correct a day's score, open a category re-selection window, or nudge a stalled device. Adjustments are made in good faith to keep the game fair and are at our reasonable discretion.

11. Suspension & termination

You can stop using the Service and delete your account at any time from inside the app (Profile, then Settings, then Delete account). Deleted accounts are deactivated at once and purged after 30 days, as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms or use the Service in a way that harms other users or the integrity of the competition. We will use reasonable judgment and, where practical, give notice.

12. The Service is provided “as is”

NIX Scoreboard is a free product offered “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. Screen-time figures are approximate and are not a medical, wellness, or professional measurement. Focus mode is a convenience, not a safety or parental-control tool. We do not guarantee the Service will be uninterrupted, error-free, or that any number, rank, or result is exact, and Apple's frameworks and policies that the Service depends on may change without notice.

13. Limitation of liability

To the fullest extent permitted by law, NIX Development LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including anything missed while Focus mode blocked an app or any dispute over a reward. Because the Service is provided free of charge, our total liability for any claim is limited to the greater of the amount you paid us (which is zero) or USD $50. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

14. Your responsibility to us

You will cover losses NIX reasonably incurs because of your content or your violation of these Terms or the law, to the extent permitted where you live.

15. Apple-required terms

The Service is licensed, not sold, to you for use only under these Terms on Apple devices you own or control, as permitted by the App Store usage rules. This agreement is between you and NIX Development LLC only, not with Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support for it. If the Service fails to conform to any applicable warranty, you may notify Apple and Apple may refund any purchase price, which for this free app is nothing; to the maximum extent permitted by law, Apple has no other warranty obligation. NIX, not Apple, is responsible for addressing any claim relating to the Service, including product liability, legal or regulatory compliance, and consumer protection, and for investigating and resolving any claim that the Service infringes a third party's intellectual property. You represent that you are not in a country subject to a US government embargo or on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes

We may update these Terms. If changes are material, we will update the effective date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept them.

17. Governing law & contact

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Michigan, unless the law where you live gives you the right to sue elsewhere.
